Terms and Conditions

§1

The on-line store Francesco Guardi is operated by LAKMA SAT Sp. z o.o., 173 Frysztacka Street, postal code 43-400 Cieszyn which is the economic operator entered into the National Court Register, No. 52607, NIP No. 548-101-03-09, REGON No. 070499284. The company is a VAT payer. The company is registered in VIES.

 

 §2

Francesco Guardi on-line store delivers products by mail via the Internet. Products offered for sale are free from defects. It shall not refer to discount products due to the specific defect indicated in the product fiche.

 

 §3

The orders may be placed through the website sklep.fguardi.com.pl. An order can be placed once the customer registers on the website. A customer can be each person of legal age or a minor with parental/legal guardian consent to register and purchase in our on-line store.

 

 §4

Immediately upon placing an order the Customer will receive an e-mail with information that the order has been accepted by the store. The order will be completed if the product is in stock of the store or its suppliers. In case some products ordered are unavailable, the Customer will be informed on the order status and decide on the method of completion of this order (partial completion, extension of expectancy, cancellation).

 

 §5

The number of products offered for promotional sales is limited, so orders will be completed according to dates of placing them, until stocks for such sales run out.

 

 §6

Each order will be accompanied by a sales document: cash register receipt or VAT invoice depending on the Customer wish. Changes to the order can be introduced by person, by phone or by the following e-mail address: sklep@fguardi.com.pl. All prices are expressed in PLN and include VAT tax. Prices expressed in other currencies are indicative. The price of each product, expressed in PLN, shall be binding at the moment of placing an order by the Customer. The store reserves the right to change prices of the products offered, introduce new products to the on-line store offer, perform and cancel promotional campaigns or make amendments in them on the store websites.

 

 §7

Cash On Delivery payment option is available only for shipments within the territory of Poland. If the value of COD order exceeds PLN 1000, the Customer may be asked for prepayment in the amount of 50% of the order value.

 

 §8

Delivery costs are calculated according to the weight and dimensions of the products ordered. The costs of courier shipment for orders exceeding the value of PLN 300 gross shall be covered at the expense of the store – it shall not concern COD shipments as well as shipments sent abroad. Personal receipt on the retail premises in Opole shall be free of charge.

 

 §9

With each product there is an approximate time of order completion indicated. It shall be the expected time elapsing from the moment of placing an order until the shipment of the order from the store, however, only workings days shall be taken into account. The products included in orders with different completion periods shall be shipped upon full completion, i.e. upon completion of the order with the longest completion period. The time of providing the shipment includes the time of the order completion and the estimated delivery time.

 

 §10

Methods of receipt:

  1. Courier shipment, the estimated delivery time is 2 days from the time of order, for shipments within Poland, and 14 days from time of order for shipments within other EU countries.
  2. Personal receipt on the retail premises in Opole at 22 Głogowska Street, during the store opening hours.

 

 §11

The customer may choose from the following methods of payment:

  1. Bank transfer to the Store account
  2. Cash On Delivery: the amount due is collected by the courier – only within the territory of Poland
  3. Pay card (Visa, Visa Electron, MasterCard, Maestro, MasterCard Electronic): the Customer is charged at the moment of placing the order
  4. ePrzelew supported by PayU service provider (Płacę z Alior Bankiem, Płacę z Alior Sync, Płacę z Nordea, Płać z ING, Przelew z BPH, Płacę z Inteligo, Crédit Agricole e-przelew, mTransfer, MeritumBank , MultiTransfer, Pekao24Przelew, Płacę z iPKO, Płacę z Eurobankiem, Przelew24 BZWBK, Przelew z CitiHandlowy, Przelew z Deutsche Banku, Przelew z BGŻ, Przelew z Getin Bankiem, Przelew z Kredyt Bankiem, Płacę z Millennium, Przelew z Invest Bankiem, Przelew z Polbankiem, Przelew z Raiffeisen Bankiem, Przelew z Bankiem Pocztowym)

 §12

Pursuant to the Act of the 2nd March 2000 regarding protection of certain consumer rights and liability for damage caused by a hazardous product, the consumer may return the product purchased in our store without stating the reason within 14 days from the date of delivery.

 

 §13

The returned products shall be sent back to the address LAKMA SAT Skład Fabryczny, 22 Głogowska Street, postal code 45-315 Opole. In case a product purchased with a VAT invoice is returned, a corrective VAT invoice shall be issued. Upon receipt, a refund will be made by means of a bank transfer to the account indicated by the customer, or by postal order to the address entered when placing the order, not later than within 14 days. If payment for the order was made by a pay card, the refund will be made to the card as well.

 

 §14

All products available in the store are covered by guarantee. Should a customer identify any technical defects during the guarantee period, he/she is entitled to exercise his/her guarantee rights in our store or in particular service points (with regard to products covered by the manufacturer’s guarantee). In case of mechanical defects which occurred during the delivery, or a claim made directly to the seller, the customer should send back the defective product by postal mail to the following address: LAKMA SAT Skład Fabryczny, 22 Głogowska Street, postal code 45-315 Opole, previously notifying the store by phone or by e-mail of the need to complain. The store will not accept any COD shipments which have been sent back. Complaints shall be examined within the statutory period from the day on which the shop received the shipment with the defective product.

In case of justified complaint, the damaged product shall be repaired or exchanged for a product of full value and if this is not possible (for instance due to stockout, discontinuation), the store shall return the equivalent of the product’s price or shall offer other products available in the store. Upon acceptance of the complaint, the costs incurred with regard to the return shipment will be reimbursed. Defective products are exempt from the guarantee. 

 

 §15

The contract of sale shall be concluded between the Customer and LAKMA SAT Sp. z o.o.

The contract of sale shall be concluded in accordance with the Polish law and in Polish language version.

 

 §16

Making an order means accepting the Terms and Conditions of Francesco Guardi store, and giving consent to collection and processing of personal data contained in the order by LAKMA SAT sp. z o.o., in accordance with applicable laws of the Personal Data Protection Act of the 29th August 1997 (Journal of Laws, No. 133, item 833) which guarantees the right to review, supplement, update and remove one’s personal data. Personal data is stored in a manner preventing access by third parties.

 

§17

To all matters not settled herein relevant regulations of the Polish Civil Code shall apply.
